1. Acceptance of Terms

By accessing or using AI CalTrack (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free, Basic, and Pro subscribers.

2. Description of Service

AI CalTrack provides AI-powered calorie and nutrition tracking. The Service includes food logging, weight tracking, progress analytics, AI food recognition from photos and text descriptions, and health calculators. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

• You must provide accurate registration information
• You are responsible for keeping your password confidential
• You must be at least 13 years old to create an account
• You may not create multiple accounts for fraudulent purposes
• We reserve the right to suspend accounts that violate these terms

4. Free & Paid Plans

AI CalTrack offers a free tier with limited daily AI scans and data retention, and paid tiers (Basic and Pro) with additional features. Paid subscriptions are billed through our payment processor (Creem).

• Free Plan — 3 AI scans per day, 7-day data history
• Basic Plan — 10 AI scans per day, 30-day data history
• Pro Plan — Unlimited AI scans, unlimited data history, priority support

5. AI Nutrition Estimates

Food recognition and nutrition data provided by our AI are estimates only. They should not replace professional nutritional advice, food labels, or medical guidance. AI CalTrack makes no guarantee regarding the accuracy of AI-generated nutrition information.

6. User Content

You retain ownership of all food entries, weight data, and photos you submit. By uploading a food photo, you grant AI CalTrack a limited license to process it through our AI for the purpose of providing the Service. We do not use your photos for any other purpose.

7. Prohibited Uses

• Using the Service for any unlawful purpose
• Attempting to reverse-engineer or extract the AI model
• Spamming, scraping, or excessively calling our APIs
• Sharing your account credentials with others
• Uploading content that is offensive, illegal, or infringes on others' rights

8. Cancellation & Refunds

You may cancel your paid subscription at any time. Access continues until the end of the current billing period. We do not offer partial refunds for unused portions of a billing cycle. Upon cancellation, your data is retained according to the data retention policy for your tier.

9. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Nutritional data from AI is approximate and should not be relied upon for medical decisions.

10. Limitation of Liability

To the fullest extent permitted by law, AI CalTrack and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to health decisions made based on AI nutrition estimates.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
